1. Acceptance of These Terms

These Terms of Service ("Terms") apply to your use of dabconsultants.com and the services, including text messaging, provided by DAB Advisors LLC ("we," "us," or "our"). By using the website, submitting a form or enrolling in our text program, you agree to these Terms and our Privacy Policy. You must be at least 18 years old to submit a request or enroll in our text program.

2. Who We Are

DAB Advisors LLC is an independent, licensed insurance agency. Devyn Barraza is a licensed insurance advisor (NPN 19742617). We are not an insurance company and not a government agency. We are not a government agency. Our agents are registered with the federal Health Insurance Marketplace (CMS) to help consumers apply for and enroll in Marketplace plans, and you can also apply directly at HealthCare.gov. We are not the Marketplace, and we are not affiliated with or endorsed by Medicare, Medicaid or any state-based exchange. We offer insurance only in states where we are licensed, and products and availability vary by state.

3. Our Services

We talk with you about your needs, show you plan options from insurance companies we are appointed with, help you apply and enroll, and help with your policy after enrollment, including questions, changes and renewals.

4. How We Are Paid

Our help is free to you. We are paid commissions by the insurance companies whose plans we sell. Those commissions do not change the premium you pay.

5. SMS / Text Messaging Program

Program description

DAB Advisors LLC offers a text messaging program for people who request a health or life insurance quote, current clients, and people who apply to join our team. You opt in by checking one or both of the optional SMS consent boxes on our quote or careers forms, or by texting us first. When you opt in, you agree to receive text messages from DAB Advisors LLC at the mobile number you provided.

Types of messages (use cases)

Customer care messages (non-marketing), if you check the customer care box:

• Follow-ups on health or life insurance quotes you requested
• Appointment scheduling, confirmations, and reminders
• Requests for information needed to complete an insurance application
• Policy, enrollment, renewal, and payment-due reminders
• Responses to questions you send us

Application update messages (non-marketing), for people who apply through our careers page and check that box: interview scheduling and reminders, application status, and onboarding information.

Marketing messages, only if you separately check a marketing box: insurance offers, open enrollment reminders, coverage tips, recruiting events, and agency news.

Example message: "DAB Advisors LLC: Hi Jordan, this is your advisor from DAB Advisors. Your health insurance quote is ready. Reply with a good time to review it. Reply STOP to opt out."

Message frequency varies based on your requests and account activity.

How to opt out

You can cancel the SMS service at any time. Text STOP to the number you received messages from. After you send STOP, we will send one confirmation message that you have been unsubscribed, and you will not receive further messages unless you opt in again. Replies of CANCEL, END, QUIT, or UNSUBSCRIBE also work.

Carrier liability

Mobile carriers are not liable for delayed or undelivered messages.

Consent not required

Consent to receive text messages is not a condition of any purchase. You can request a quote and buy a policy without agreeing to receive texts.

Privacy

Your mobile information is handled as described in our Privacy Policy. We do not sell or share your mobile number or text messaging opt-in data with third parties or affiliates for their marketing or promotional purposes.

6. Phone and Email Contact

When you submit a form, you ask us to contact you about your request by phone and email at the number and address you provide. You can ask us to stop at any time by telling your advisor, replying STOP to texts, using the unsubscribe link in any email, or contacting us. Agreeing to be contacted is not a condition of purchase.

7. Quotes and Coverage

Submitting a form is a request for information. It is not a quote, an application or a guarantee of coverage. Quotes are estimates. Final premiums, eligibility and coverage are decided by the insurance company after application and any underwriting, and the policy documents issued by the insurance company control your coverage.

8. Accurate Information

You agree to give truthful, complete information. Incorrect or missing information can lead an insurance company to deny an application, change the price, or cancel or rescind coverage.

9. No Medical, Legal or Tax Advice

Information on this website is general and for educational purposes. It is not medical, legal, tax or financial advice. Talk with a qualified professional about those decisions.

10. Website Use and Availability

You agree not to use the website for any unlawful purpose, submit false information, impersonate anyone or interfere with how the site works. The website is provided "as is" and "as available." We may change, suspend or remove any part of it at any time.

11. Intellectual Property

The text, design, logo and graphics on this website belong to DAB Advisors LLC and may not be copied, reproduced or adapted without our written permission.

12. Third-Party Links and Services

Our website links to or uses outside services, such as scheduling tools and insurance company websites. We do not control those services and are not responsible for their content, policies or practices.

13. Limitation of Liability

To the fullest extent allowed by law, DAB Advisors LLC is not liable for indirect, incidental, special or consequential damages arising from your use of the website or text program. Our total liability for any claim related to the website is limited to the greater of the amount you paid us for the service involved or $100. Nothing in these Terms limits liability that cannot be limited under law, including duties owed under Florida insurance law.

14. Indemnification

You agree to cover any claims, losses or costs we incur because you broke these Terms or misused the website.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Sarasota County, Florida. You may also contact the Florida Department of Financial Services, or the insurance department in your state, with a complaint.

16. Licensing and Advertising

DAB Advisors LLC and its advisors sell insurance only in states where they hold an active license and are appointed with the insurance company. Not all products, plans or carriers are available in every state. Agent and agency license numbers for any state are available on request by contacting us. Any earnings or income examples shown for our career opportunity are illustrations, not guarantees.

17. Accessibility

18. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the website.

We may update these Terms from time to time. The date at the top shows when they last changed. Continued use of the website or text program after a change means you accept the updated Terms.
